5. ОТВЕТСТВЕННОСТЬ СТОРОН

5.1. В случае неисполнения или ненадлежащего исполнения своих обязательств по договору Стороны несут ответственность в соответствии с условиями договора и нормами действующего законодательства Российской Федерации.

5.2. Сторона, не исполнившая или ненадлежащим образом исполнившая обязательства по настоящему договору, обязана возместить другой Стороне причиненные таким неисполнением реальные убытки.

5.3. В случае неисполнения или ненадлежащего исполнения настоящего договора за которое Исполнитель несет ответственность, Исполнитель обязан уплатить Заказчику неустойку, предусмотренную договором. При этом общий размер указанных выплат ограничен суммой реального ущерба, причиненного Заказчику.

5. RESPONSIBILITY OF THE PARTIES

5.1. In the case of non-performance or improper performance of their obligations under the Contract the Parties shall be responsible in accordance with the terms of the Contract and the standards of the current legislation of the Russian Federation.

5.2. The party that failed to perform or improperly performed its obligations under the present Contract shall compensate the real losses caused by such non-performance to the other party.

5.3. In the case of non-performance or improper performance of the Contract for which the Contractor is responsible, the Contractor shall pay the penalty stipulated by the Contract to the Customer. The total amount of these payments is limited by the sum of the real damage caused to the Customer.

4.            ПОВЕРЕННЫЙ оказывает услуги по оформлению настоящего Договора купли-продажи на основании договора поручения №б/н от /дата/.

5.            ПРОДАВЕЦ гарантирует, что до заключения настоящего договора отчуждаемое АМТС никому другому не продано, не заложено, в споре или под арестом (запрещением) не состоит, правами третьих лиц не обременено.

6.            Настоящий договор вступает в силу с момента его подписания.

7.            АМТС должно быть зарегистрировано в ГИБДД в течение 10 суток с момента покупки.

8.            Первый экземпляр хранится в МРЭО ГИБДД по месту последующей регистрации.

4. The ATTORNEY renders services of registration of the present Sale and Purchase Agreement on the basis of the Agency Agreement No. /unnumbered/ dated /date/

5. The SELLER ensures that before signing of the present Agreement the alienated Engine Vehicle (AMTS) had not been sold or mortgaged to anyone, was not in a dispute or under detention (ban) and was not encumbered by the rights of third parties.

6. The present Agreement shall come into force upon its signature.

7. The Engine Vehicle (AMTS) must be registered with the State Road Traffic Safety Authority within 10 days after its purchase.

8. The first copy is kept in the Interdistrict Registration-Examinational Office of the State Road Traffic Safety Authority at the place of subsequent registration.

5. Квартира до настоящего времени никому не продана, не заложена, в споре и под запретом/арестом не состоит.

6. “Граждане" осуществляют право владения, пользования и распоряжения квартирой в соответствии с законодательством Российском Федерации.

7. “Граждане“  осуществляют за свой счет эксплуатации и ремонт квартиры с соблюдением существующих единых правил и норм на условиях, определенных для домов государственного и муниципального жилищного Фонда, а также обязаны участвовать в общих расходах по обслуживанию и ремонту дома, его инженерного оборудования и содержанию придомовой территории пропорционально доле занимаемой площади в этом доме.

5. The apartment has not yet been sold, mortgaged, in dispute or prohibited (seized).

6. “Citizens” exercise the rights of possession, use and disposal of the apartment, in accordance with the Law of the Russian Federation.

7. “Citizens” repair and exploit the apartment at their own expense, complying with the existing uniform rules and standards as specified for the houses of state and municipal residential property; they also have to share general expenses for maintenance and repair of the house, its utility equipment and cartilage maintenance in proportion to the share occupied by them in this house.
